Ben Regnard-Weinrabe is a partner in the Global Banking & Payment Systems practice at Paul Hastings and is based in the firm’s London office.

Mr. Regnard-Weinrabe has extensive experience of the commercial and retail banking and payments industries, advising on EU and UK law and regulation, products, commercial contracts and transactions. He also advises on non-sector specific legislation such as unfair terms, money laundering, e-commerce and data protection. He has a special focus on innovation in financial services, including mobile payments, e-money and virtual currencies.

Clients include commercial and retail banks, card issuers, e-money and payment institutions, mobile operators, retailers, and consumer finance providers

Mr. Regnard-Weinrabe is fluent in French and has conversational Spanish.

Experience

  • Assisting a number of banks, e-money institutions, retailers, mobile operators and a payments infrastructure provider on their lobbying in relation to the proposed second Payment Services Directive and other legislation
  • Advising numerous clients on set up and/or operation of their businesses on a cross-border basis, particularly across the EU
  • Advising on a project to set up a new global payments scheme
  • Advising on a number of applications for authorisation of e-money and payment institutions, lenders and a bank
  • Helping lead projects for a number of major firms on the implementation of new requirements under the first Payment Services Directive, the Second E-Money Directive, Banking Conduct of Business Sourcebook and Consumer Credit Directive
  • Working on several mobile payments ventures between banks or payments providers and telecoms operators
  • Advising merchant acquirers and payment facilitators on their documentation and regulatory status, including restructuring of their arrangements
  • Acting for clients in response to potential or actual enforcement action by the FSA and OFT
  • Negotiating entry into a major loyalty programme contract on behalf of a leading UK retail bank
  • Advising on strategic options and implementation projects for retailers entering into the e-money and consumer finance markets
  • Advising on integration and other projects following various post credit crunch bank reorganisations
  • Advising card issuers and lenders on existing and new consumer credit and mortgage lending, including documentation drafting and general advice
  • Advising card issuers and lenders on entry into co-brand and BIN sponsorship agreements
  • Assisting with transfers under Part VII FSMA of savings and mortgage portfolios
  • Acting on a number of debt sales and acquisitions
